FAQ for Business Defamation and Trade Libel Matters

What is the difference between business defamation and trade libel under Nevada law?

While both involve false statements that harm a company, they protect different corporate interests. Business Defamation protects the business’s overall reputation, integrity, and creditworthiness. For example, falsely claiming a company uses child labor or is filing for bankruptcy constitutes business defamation.

Trade Libel (or Product Disparagement) protects the economic marketability of your specific goods or services. For example, falsely stating that a restaurant’s food contains toxic ingredients or that a contractor’s building materials are fundamentally defective is trade libel. Trade libel requires the plaintiff to prove “special damages”, meaning a specific, quantifiable loss of sales or customers directly caused by the statement.

What is the statute of limitations for filing a business defamation lawsuit in Nevada?

Under NRS 11.190(4)(c), the statute of limitations for an action for libel or slander in Nevada is two (2) years. The timeline generally begins to run on the date the defamatory statement was first published or spoken.
